| PRICES: |
|
| a) |
The price of each product is displayed with the product. |
|
| DELIVERY OF REPORTS: |
|
| a) |
Reports are displayed on-line and the report will also be sent via e-mail to your registered e-mail address. |
|
| Before you embark on any search, please look at the specific report description and example pages listed on the homepage. |
|
| VALUE ADDED TAX: |
|
| a) |
Value added tax at the rate of 14% is charged. |
|
| DELIVERIES: |
|
| a) |
All reports are delivered on-line and the e-mail is sent immediately. Please refer to the minimum specifications to view and print the reports. |
|
| PAYMENT METHODS: |
|
| a) |
PropertySPI uses Mobile Merchant. Please refer to Mobile Merchant for more dtails. |
|
| b) |
Payment is collected once the buyer accepts the PropertySPI data search match count and selects the 'Buy' option. The report will be displayed once confirmation is received from Mobile Merchant that payment has taken place. |
|
| c) |
Note that to protect it's own and the interests of customers, Mobile Merchant and PropertySPI scrutinize all transactions very carefully to prevent attempted fraud and a transaction may be refused if we are not satisfied with it's legitimacy. |

| AGREEMENT OF SALE: |
|
| a) |
An agreement of sale between PropertySPI and a user only comes into effect if and when a payment confirmation from Mobile Merchant is received by PropertySPI. |
|
| b) |
PropertySPI reserves the right to refuse to accept and/or execute an order without giving any reasons. PropertySPI also reserves the right to cancel orders in whole or in part as circumstances dictate. PropertySPI shall only be liable to refund monies already paid by the user. |
|
| REFUNDS / EXCHANGES: |
|
| a) |
If PropertySPI supplies the wrong report, PropertySPI will replace the report with the correct one. However, if replacement is not possible , PropertySPI will refund the purchase price. Notice by e-mail (contact@propertySPI.co.za) of a wrong report must be received within five working days after the report has been e-mailed to the user. No reports will be replaced or refunded after this period. |

| REGISTRATION: |

| a) |
Completing the Property24 Shop registration form signifies acceptance of these terms and conditions without any modification. On completion of your registration these terms and conditions and the standard Property24.com website terms and conditions will form a binding legal agreement between the user and PropertySPI. |

| b) |
Reports ordered may only be used for the personal use of the purchaser and not to obtain any direct financial gain or for any other commercial purpose whatsoever. |
|
| c) |
The user must ensure that all the details provided are true and correct. PropertySPI shall not be liable for any expenses, costs or damages incurred as a result of incorrect details. |

| GOVERNING LAW: |

| a) |
This site is hosted, controlled and operated from the Republic of South Africa and therefor governed by South African law. |
|
| PRIVACY: |
|
| a) |
PropertySPI shall take all reasonable steps to protect the personal information of Users. For the purpose of this clause, "personal information" shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). PropertySPI may electronically collect, store and use the following personal information of Users: name and surname; birth date; gender; country of residence; closest city; address; non-personal browsing habits and click patterns; e-mail address; and IP address. |

PropertySPI collects, stores and uses the abovementioned information for the following purposes: to greet the User when he/she logs into the web site; subject to the User's consent, inform the User of facts relating to his/her access and use of the PropertySPI website; subject to the User's consent, inform the User about competitions and special offers from PropertySPI and/or its partners / affiliates; to compile non-personal statistical information about browsing habits, click-patterns and access to the PropertySPI web site. |

| d) |
Information detailed above is collected either electronically by using cookies or is provided voluntarily by the User. Users may determine cookie use independently through their browser settings. |

| e) |
The User may elect not to receive any communications from PropertySPI and/or its partners / affiliates. |

| f) |
PropertySPI may collect, maintain, save, compile, share, disclose any information collected from users, subject to the following provisions: |

PropertySPI shall not disclose personal information from Users unless the User consents thereto; |

PropertySPI shall disclose information without the User's consent only through due legal process; and |

PropertySPI may compile, use and share any information that does not relate to any specific individual. |

PropertySPI owns and retains all rights to non-personal statistical information collected and compiled by PropertySPI. |

| SECURITY: |
|
| a) |
Any person that delivers or attempts to deliver any damaging code to this web site or attempts to gain unauthorised access to any page on this web site shall be prosecuted and civil damages shall be claimed in the event that PropertySPI suffers any damage or loss. |
|
| b) |
The user agrees and warrants that its log-in name and password shall: be used for personal use only; and not be disclosed to any third party. |

| c) |
The user allows PropertySPI to take all reasonable steps to ensure the integrity and security of the PropertySPI and back-office applications. |

| CHANGES TO AGREEMENT: |

| a) |
PropertySPI may, in its sole discretion, change this agreement or any part thereof at any time without notice. |
